Professor Choudhry’s research addresses constitutional design as a tool in the management of the transition from violent conflict to peaceful democratic rights. It is from such a viewpoint that he and other constitutional law scholars wrote an open letter to the Catalan and Spanish governments. The scholars state that constitutional settlement should be adopted recognizing the rights of both sides while accepting the Catalan people’s ambitions.
In the letter, Professor Choudhry and the scholars illustrate that it is in the best interests of residents of theSpanish and Catalonian government to work out an amicable and orderly ending of the dispute to prevent the undermining of foundation ideals of the European Union. It was discovered that Spain tried its best to derail the Catalonian people from holding a referendum and that the Catalonian government used heavy-hand techniques to deal with its people.
